What a Trump Administration Means for Employment Law

After a long, grueling campaign season, democracy has spoken and Donald Trump is President-elect. Here’s what you need to know about Trump’s stances that could affect your workplace policies and practices:

Affordable Care Act (ACA)

Trump supports a complete repeal of the Affordable Care Act. His position is to “work with states to create high risk pools for individuals who have not maintained continuous coverage” instead of requiring insurers to provide coverage to all. His position supports providing a tax deduction for the purchase of individual health insurance in place of refundable premium tax credits.

Trump also aims to promote a competitive market between health plans by eliminating restrictions that currently prevent insurers to sell plans across state lines.

Trump’s stance on immigration has the potential to make a significant impact on employment law. Besides wanting to deport segments of undocumented workers, the Trump administration supports “mandating E-Verify to check the employment eligibility of all workers in the country, and altering the temporary work visa programs which allow employers to bring on highly skilled foreign workers.”

Minimum Wage

Trump came out to state that he supports a federally mandated minimum wage increase to $10/hr. However, he also noted that he believes that wages should be determined at the state and local levels.

Other Note-Worthy Stances

The Trump administration favors paid maternity leave for six weeks.

In regards to childcare, Trump seeks to make childcare costs tax-deductible, and supports “incentivizing employers to provide childcare at the workplace.”
